20.040 Debtor and Creditor; Right of Debtor to Prefer Creditors A debtor may pay one creditor before another, and in that regard, the debtor may in good faith give a creditor a lien by mortgage or other legal means, or the debtor may sell the creditor something in payment of the debt or may transfer a cause of action as security for the debt when the surplus is not reserved for the debtor's own benefit.
