Instruction No 1 32.17 [1995 Invalidating Will Revision] Affirmative Defenses--Will Contest--Fraud Your verdict must be that the document in issue is not the last will and testament of (name of testator ) if you believe: First, (insert name of person committing fraud ) represented to (name of testator ) that (here state the allegedly false representation ), and Second, such representation was false, and Third, (insert name of person committing fraud ) knew such representation was false, and Fourth, such representation was intended to and did deceive (name of testator ), and Fifth, (name of testator ) relied upon such representation, and Sixth, (name of testator ) was induced to sign the document in issue by reason of such representation.
