Instruction No 1 27.04 [1981 Revision] Verdict Directing--Ejectment--Counterclaim for Value of Improvements If your verdict is for plaintiff on his claim for possession of the premises, your verdict must be for defendant on his counterclaim if you believe: First, defendant entered into possession of the premises under a good faith claim of title to the premises and without knowledge of plaintiff's claim to possession, and Second, the improvements were made in good faith on the premises prior to defendant's having notice of plaintiff's claim to possession of the premises. * [unless you believe defendant is not entitled to recover by reason of Instruction Number (here insert number of affirmative defense instruction ) ].
