IN THE MAGISTRATE’S COURT AFFIDAVIT FOR DELIVERY OF PERSONAL PROPERTY (CONSUMER CREDIT TRANSACTION). This form is used in the Magistrate’s Court of Richland County when a creditor seeks to repossess personal property that was purchased through a consumer credit transaction and is secured by a security agreement. This form allows the plaintiff to swear under oath that the defendant defaulted on payments required under the purchase agreement, that proper notice to cure the default was given as required by law, and that the defendant failed to bring payments current. It also documents that the plaintiff attempted to recover the property peacefully, but the defendant refused to voluntarily surrender it, thereby wrongfully retaining possession of the collateral.
