MAD-CIV-005 - EX-PARTE DECLARATION. This is a local form adopted by the Superior Court of California, County of Madera, used when a party or attorney requests emergency (“ex parte”) court orders without the standard notice period. This declaration satisfies California Rules of Court, Rule 3.1200 et seq., requiring the filing party to declare whether notice of the ex-parte hearing was given to the opposing party—or to explain why notice was not possible. The form provides options for the method of notice (telephone, in person, or other), or justification for lack of notice due to immediate and irreparable injury or where notice would frustrate the purpose of the order.
