Description

NOTICE AND CONSENT TO MAGISTRATE JUDGE JURISDICTION. This form is used in the United States District Court for the Southern District of Illinois to inform parties in a civil case of their option to have a United States magistrate judge preside over the matter instead of a district judge. The form explains that a magistrate judge may conduct all proceedings in the case, including jury and nonjury trials, and may enter a final judgment under 28 U.S.C. § 636(c). Any final ruling by a magistrate judge can be appealed directly to the appropriate United States court of appeals, just as with a district judge’s decision. The form emphasizes that a magistrate judge may only assume jurisdiction if all parties voluntarily consent, and that there are no adverse consequences for consenting or declining. Each party must indicate their choice by checking the appropriate box, printing and signing their name, and submitting the form by the deadline set by the Clerk of Court. If all parties consent, the case will be assigned to a magistrate judge; if not, it will remain with or be reassigned to a district judge. www.FormsWorkflow.com
