AGMHD - AGREEMENT TO PARTICIPATE MENTAL HEALTH DIVERSION. This form is used by the San Mateo County Mental Health Diversion (MHD) program to document a defendant’s voluntary agreement to participate in the program and comply with its requirements. By signing, the defendant acknowledges that they must follow an approved treatment plan, attend MHD court as required, and understand that failure to comply or being arrested for another crime may result in their case being returned to criminal court for prosecution. The agreement also outlines that restitution may still be ordered, participation may last up to two years, and the defendant must sign a release of information allowing the MHD team—including the judge, attorneys, mental health professionals, treatment providers, and probation—to access and share relevant personal, legal, and medical details. The defendant agrees to follow their treatment plan, take prescribed psychiatric medication, and waive their right to a speedy trial.
