Description
Form 2 - CLAIM AFFIDAVIT. This is the initial form filed by a plaintiff to begin a case in North Dakota Small Claims Court under the North Dakota Small Claims Court Act (N.D.C.C. ch. 27-08.1). This form provides a short written statement describing the reason for the claim, the amount of money being sought, and the facts supporting the claim. It must include the full names and addresses of all plaintiffs and defendants. The plaintiff must sign the affidavit under penalty of perjury and file it with the Clerk of District Court in the appropriate county, along with a filing fee of $20 (effective July 1, 2025; previously $10). After filing, the plaintiff must serve the defendant(s) with copies of specific small claims court forms, including this completed claim affidavit, a blank Request for Hearing/Removal to District Court (Form 3), and a Defendant’s Answer and Counterclaim (Form 4). Proof of service must then be filed using Form 6 – Affidavit of Service or a sheriff’s certificate. Once served, the defendant has 20 days to either request a hearing in small claims court or remove the case to district court. If a hearing is requested, the court will schedule it within 10 to 30 days, and both parties must appear.
