Description

RT-130 - RETAIL CRIME RESTRAINING ORDER (CLETS–RTO). This form is a court-issued order used in California to prohibit an individual (the restrained person) from entering or approaching a specific retail establishment due to past criminal conduct such as shoplifting, theft, vandalism, or assault of retail staff. Filed after a court hearing, the order identifies the restrained person with detailed personal information and prohibits them from entering the business, its premises, or adjacent parking lots. The court may also apply the order to other stores in the same chain or franchise within a certain distance. This form ensures the order is enforceable by law enforcement by requiring it to be entered into the California Restraining and Protective Order System (CARPOS) via CLETS. If the restrained person was not present at the hearing, personal service of the order is required. Violating the order can result in arrest and criminal penalties. The order remains in effect until the listed expiration date or for two years by default if none is specified. Judicial Council of California Mandatory Form. Pen. Code, § 490.8. www.FormsWorkflow.com
