Description

JV-239 - ORDER ON PLACEMENT IN SHORT-TERM RESIDENTIAL THERAPEUTIC PROGRAM OR COMMUNITY TREATMENT FACILITY. This form is used by the Superior Court of California to review and issue an official order regarding a child’s or nonminor dependent’s placement in a Short-Term Residential Therapeutic Program (STRTP) or Community Treatment Facility. The purpose of the form is to determine whether the child’s or nonminor’s mental and behavioral health needs can be met in a family-based setting or if a higher level of care, such as an STRTP or community treatment facility, is necessary and appropriate. The form documents the court’s findings based on reports, input from parties involved, and other submitted materials, and it includes decisions on whether notice requirements were met, if a hearing was conducted or waived, and whether the proposed placement is approved or disapproved. The court also considers whether the placement aligns with the individual’s treatment goals and permanency plan and issues orders related to the continuation or transition of the placement. If the child is an Indian child, the court addresses whether there is good cause to depart from ICWA placement preferences. Form Adopted for Mandatory Use Judicial Council of California. Welfare and Institutions Code, §§ 361.22, 727.12; Cal. Rules of Court, rule 5.618. www.FormsWorkflow.com
