Form 7-4 - PETITION. This is a New York Family Court form used to initiate a proceeding under Article 7 of the Family Court Act (FCA §§712, 732, 733, 736). It is filed by an authorized person—such as a parent, guardian, school official, or authorized agency—alleging that a child under 18 is a Person in Need of Supervision (PINS). Grounds for the petition may include habitual truancy, being ungovernable or beyond parental control, or violating Penal Law §230.00 (prostitution). The petitioner must provide identifying information about the respondent, parents or guardians, and any noncustodial parent. The form also requires a concise statement of the alleged acts, proof of diversion service referral under FCA §735, and, if applicable, notification of tribal authorities under the Indian Child Welfare Act (ICWA). The petitioner verifies the allegations under penalty of perjury, and the form warns that parents or guardians may be liable for child support if the child is placed in care.
