NOTICE OF APPEAL TO APPELLATE DIVISION, THIRD DEPARTMENT FROM CRIMINAL CONVICTION. This form is used in the State of New York to begin an appeal from a criminal judgment to the Supreme Court, Appellate Division, Third Judicial Department. This document notifies the court and the district attorney that the defendant intends to appeal a judgment of conviction and sentence, as well as any intermediate orders or rulings made in the lower court. The form requires the defendant to provide identifying details such as the indictment or SCI number, the court and county of conviction, and the date of judgment. The notice must be signed, dated, and filed in duplicate with the Clerk of the Court where the conviction occurred, and a copy must also be served on the District Attorney of the county of conviction.
