Description

FORM MISC.07 – ATTORNEY/FIDUCIARY INVENTORY CHECKLIST. These forms are used in the Summit County Probate Court as part of the process for administering a deceased person's estate, specifically related to the Inventory and Appraisal of the estate's assets. The Attorney/Fiduciary Inventory Checklist is used to ensure that all necessary documents and information have been properly completed and submitted along with the inventory filing. It requires the fiduciary (executor or administrator) and attorney (if one is involved) to confirm that all assets have been accurately itemized, appropriately valued, and supported with the required documentation—such as property appraisals, vehicle details, bank account information, and valuations of savings bonds. The checklist also confirms that legal requirements such as the waiver by a surviving spouse and any required bonds are in place, and that the inventory aligns with prior filings in the case if applicable. The Inventory and Appraisal forms themselves are the official record of all assets belonging to the decedent as of the date of death. They categorize the estate into tangible personal property, intangible property, and real estate, and include an itemized schedule of each asset and its value. The fiduciary is responsible for assigning values to assets that are easily verifiable, while assets without easily determined values must be appraised by a court-approved appraiser. The appraiser must sign a certification affirming that their valuations were impartial and accurate. If any vehicles are transferred to the surviving spouse, their value must be listed and cannot exceed the statutory limit ($40,000 for dates of death on or before April 5, 2017, and $65,000 for dates after). Additional forms such as the Waiver of Notice of Taking of Inventory and Waiver of Notice of Hearing on Inventory allow the surviving spouse or other interested parties to waive formal notice, expediting the process. The Entry Setting Hearing sets the date and time for the court to review and approve the submitted inventory. www.FormsWorkflow.com
