NOTICE OF VOLUNTARY DISMISSAL AS TO COUNTERCLAIM. This form is used in the County Court of Citrus County, Florida, in cases governed by either civil or small claims procedure. This form allows a defendant, who has also filed a counterclaim against the plaintiff, to formally withdraw or dismiss that counterclaim from the case. It is submitted pursuant to Rule 1.420 of the Florida Rules of Civil Procedure and Rule 7.110(a) of the Florida Small Claims Rules. By filing this notice, the counter-plaintiff signals their intent to voluntarily discontinue legal action related to the counterclaim without needing a court order. The form must be signed and dated by the counter-plaintiff and is subject to verification by the Clerk of Courts or a notary public.
