FORM 16.1 - AFFIDAVIT [R.C. 3109.27]. This form is used in the Probate Court of Ohio, is required when an individual is seeking guardianship of the person of a minor. It is intended to provide the court with essential background information regarding the child's living arrangements and custody status. The person filing the affidavit (the affiant) must disclose the child’s current address, all residences from the past five years, and the names and addresses of all individuals the child has lived with during that time. Additionally, the affiant must state whether they have been involved in any custody-related legal proceedings in Ohio or any other state, whether they are aware of any current custody proceedings, and whether they know of anyone who currently has or claims to have custody or visitation rights. If any of these items are answered affirmatively, the affiant must provide further details, which may be attached separately.
