AOC-DRC-16 - MEDIATED SETTLEMENT AGREEMENT MSC PROGRAM. This form is used in the North Carolina Superior Court Division to officially document the terms of a complete settlement reached during a Mediated Settlement Conference, as authorized by Rule 4(c) of the Rules for Mediated Settlement Conferences and Other Settlement Procedures in Superior Court Civil Actions. This form is completed when all parties in a civil case—plaintiff(s) and defendant(s)—agree to resolve the dispute and finalize all issues without proceeding to trial. It records the date and location of the mediation, confirms that a full agreement has been reached, and provides space for detailing the specific terms of that agreement. The form may also state whether a Consent Judgment or Order will be drafted and which party's attorney is responsible for preparing it. In general, each party agrees to bear their own legal fees and costs related to the mediation unless otherwise specified. This form is not intended for use in cases involving self-represented (pro se) litigants; in such instances, a mediation summary form (AOC-DRC-18) is recommended instead.
