CIRCT 4108 - APPLICATION FOR TRIAL DE NOVO. This form is used in the 16th Judicial Circuit of Missouri—either in Kansas City or Independence—for small claims and rent and possession cases. A party who has received a judgment from the court within the last 10 days may use this form to formally request a new trial, known as a trial de novo. The applicant must understand that submitting this form does not automatically stop (or stay) the enforcement of the judgment unless a court-approved bond is posted with the application. If the request is later dismissed or if the judgment is upheld or reentered against the applicant, the bond may be used to pay the judgment and court costs. In landlord-tenant cases, additional requirements apply, including that the bond must cover all damages, costs, and rent due, and that ongoing rent must be paid into the court during the appeal process.
