FORM 115 - NOTICE OF INTENT TO RELOCATE. This form is used in the Summit County Domestic Relations Court by a parent or legal guardian who intends to move to a new residence, either within or outside the current county or state, and whose move may impact existing parenting time or custody arrangements. In compliance with Ohio Revised Code §3109.051(G) and Local Rule 2.09, the relocating parent must provide advance written notice of the intended move to both the court and the other parent. The required notice period varies depending on the location of the move: at least 30 days for moves within the child’s current county, 60 days for moves elsewhere in Ohio, and 90 days for moves outside of Ohio. The form identifies the child(ren) involved, the intended new address (unless withheld for safety reasons), the proposed date of the move, and whether the other parent agrees or objects to the relocation. If both parties agree, they may submit a notarized Agreed Judgment Entry to the court without needing a hearing. If there is no agreement, the relocating parent may request an informal proceeding or a court hearing to resolve disputes and review parenting time modifications.
