M-ADR2 - STIPULATION AND ORDER REFERRING MATTER TO ALTERNATIVE DISPUTE RESOLUTION. This form from the Superior Court of California, County of Merced is used when all parties in a civil case mutually agree to resolve their dispute through an ADR (Alternative Dispute Resolution) process rather than proceeding directly to trial. This form documents the parties’ stipulation to participate in a specific ADR method, such as mediation, binding or non-binding private arbitration, neutral case evaluation, private settlement conference, or early mediation. It must be filed with the court within fifteen (15) calendar days of the parties’ agreement to participate in ADR. The form includes the name and contact information of the neutral provider, the deadline for completing the ADR process, and the date of the next scheduled Case Management Conference if applicable. By signing the stipulation, the parties confirm that they have agreed on how to divide the cost of the ADR provider, that all parties have been served and submit to the court's jurisdiction, and that they have agreed to a discovery plan that supports a meaningful ADR process. If the parties choose early mediation, a $300 fee must be submitted with the filing.
