MEDICAL POWER OF ATTORNEY DESIGNATION OF HEALTH CARE AGENT (MPOA) Advance Directives Act (see §166.164, Health and Safety Code). This form is used to legally appoint someone—called a health care agent—to make medical decisions on your behalf if you become unable to make them yourself. This form is authorized under the Texas Advance Directives Act and becomes effective only when a physician certifies in writing that you are incapacitated. The agent you designate is empowered to make a wide range of health care decisions for you, such as consenting to or refusing treatment, including life-sustaining measures, based on your wishes and values. You may also specify limitations on the agent’s authority and name alternate agents in case your primary agent is unavailable or unwilling to act.
