Description

CHANGING A RESTRAINING ORDER UNDER THE FAMILY ABUSE PREVENTION ACT (FAPA). This packet of forms is used to request a change—also known as a modification—to an existing restraining order issued under the Family Abuse Prevention Act (FAPA) in Oregon. Either the Petitioner (the person protected by the order) or the Respondent (the person restrained by the order) may request changes, but only certain terms of the order can be modified. These include changes to custody and parenting time, the Respondent’s removal from the home, restrictions on access to certain premises, or the level of contact permitted with the Petitioner. Different forms within the packet apply depending on who is requesting the change and the nature of the modification—whether the terms are to become more or less restrictive. After filing the appropriate form with the court, the process may involve a judge’s review, a hearing, and formal service of the paperwork to the other party. Some changes, particularly less restrictive ones requested by the Petitioner, may be granted without a hearing unless the Respondent objects within 30 days. The packet includes detailed instructions on how to proceed, what happens after filing, how to serve the other party, and how to ensure proper notice and attendance for any required hearings. It also provides additional forms for use in updating confidential contact information, requesting interpreter services or accommodations, and complying with firearm surrender laws if applicable. While legal representation is not required to complete these forms, it is recommended for those who have questions about the legal process. www.FormsWorkflow.com
