HOU105 - AFFIDAVIT IN SUPPORT OF REQUEST FOR EXPEDITED HEARING (Minn. Stat. § 504B.321, subd. 2). This form is used in eviction cases filed in Minnesota District Court. It allows a landlord or their authorized agent to formally request an expedited court hearing when urgent circumstances are present. According to Minnesota Statute § 504B.321, subdivision 2, expedited hearings may be granted when a tenant has allegedly engaged in unlawful activities, behavior that seriously endangers the safety of other residents, or has intentionally and seriously damaged the landlord’s or another tenant’s property. The person submitting the form must outline the specific facts and incidents that justify the need for an accelerated court date, and they must sign the affidavit under penalty of perjury, affirming the truth of the information provided. If the court determines that the request was made in bad faith or without a factual basis, a penalty of up to $500 may be imposed. www.FormsWorkflow.com
