WAIVER OF FOURTEEN DAY RULE FOR FILING OBJECTIONS TO REPORT AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE. This form is a form used in the United States District Court for the Western District of Texas, Waco Division. This form allows both the defendant and the government to voluntarily waive the standard 14-day period provided under 28 U.S.C. § 636(b)(1)(C) for filing written objections to a magistrate judge’s report and recommendation. Parties have 14 days to review and object to a magistrate’s findings before the district court acts on the recommendation. However, by signing this waiver, the defendant (with the advice of counsel) and the Assistant U.S. Attorney both agree to give up that right, thereby permitting the district court to proceed immediately with ruling on the magistrate judge’s recommendation without waiting for the objection period to expire. www.FormsWorkflow.com
