PETITION FOR CHANGE OF NAME OR SEX (MINOR CHILD). This packet is used to request a legal change of name, legal sex, or both for either an adult or a minor in the state of Oregon. The process begins by completing a Petition for Change of Name / Sex and a Judgment for Change of Name / Sex—selecting the applicable options (name change, sex change, or both). The individual filing the petition is referred to as the Petitioner. For minors, the Petitioner must be a parent, legal guardian, or other legal representative. If the petition involves changing a minor's name, the Petitioner must notify the other parent(s) or guardians unless specific exceptions apply, and must file a Declaration of Notice confirming that notice was given. The forms must be filed with the appropriate circuit court: for name changes, in the county where the Petitioner or child resides; for sex changes, in any circuit court in Oregon. Filing fees apply, and while a court appearance is usually not required, a judge may request one in certain cases. Once approved, the court enters a judgment officially changing the legal name and/or sex. This judgment does not automatically update any other records, so individuals must submit the judgment to agencies like the DMV, Social Security Administration, and the Oregon Health Authority to update documents such as birth certificates, driver’s licenses, and social security cards. If a party involved in the process—especially a minor or someone who is incapacitated—needs legal representation to protect their interests, a Guardian ad Litem (GAL) may be appointed by the court. There are separate forms and procedures to apply for a GAL, and notice must be given to relevant parties.
