Description
FL-271 - EX PARTE APPLICATION AND ORDER TO FILE ADDITIONAL DOCUMENTS UNDER LOCAL RULE 7-102.5. This form is used in the Superior Court of California, County of San Joaquin to request court approval for submitting additional documents beyond the standard limits set by Local Rule 7-102.5. The rule restricts the number of declarations a party can file in support of or in response to a Request for Order (RFO), a Domestic Violence Restraining Order (DVRO), or an Elder Abuse Restraining Order (EARO). Generally, parties may submit only one declaration in support, one in response, and one reply declaration, with a 10-page limit for evidentiary attachments. If a party needs to submit additional declarations or exceed the page limit, they must apply to the court ex parte—meaning without a formal hearing—with prior notice to the other parties. The application must list and describe the additional documents, explain their necessity, and comply with California Rules of Court, Rule 5.151. If the court grants the request, the additional documents can then be filed; otherwise, they will not be considered. Form Adopted for Optional Use. www.FormsWorkflow.com
