Order Of Publication

SC-3 - ORDER OF PUBLICATION. This form is used in the Superior Court of Gwinnett County that authorizes service by publication when a defendant cannot be personally served with legal documents. This form is used when the defendant resides out of state, has left the state, cannot be found despite diligent efforts, or is actively avoiding service. The court orders that notice of the legal action be published in a designated legal newspaper or other public forum, allowing the defendant to be informed of the case against them. The clerk of the court then certifies that the notice was published and mailed to the defendant’s last known address.
