CLAIM BY CREDITOR AND CERTIFICATION OF SERVICE. This form is used by individuals or companies to formally present a monetary claim against a decedent’s estate through the Surrogate’s Court in New Jersey. Under N.J.S.A. 3B:22-4, creditors are required to submit their claims in writing and under oath within nine months of the decedent’s death, detailing the amount owed and the nature of the debt. This process ensures that claims are considered during the estate administration before final distribution of assets. To proceed, the creditor must determine whether an estate has been opened by contacting the Surrogate’s Court or submitting a judiciary records request form with a search fee. Once confirmed, the creditor must complete two original copies of the claim: one must be sent to the estate’s personal representative, and the other filed with the Surrogate’s Court, along with the required $5.00 per-page filing fee. All signatures must be original and notarized—electronic or stamped signatures are not accepted. A Certification of Service must be completed, affirming that a copy of the claim was properly mailed to the personal representative.
