ABANDONED NAME AFFIDAVIT. This form is used to register a business name that conflicts with an existing name already on file with the Minnesota Secretary of State, but where the current holder of that name cannot be located to obtain consent. This form is filed when an individual or entity wishes to register a name that is already taken, but they have made efforts to contact the current holder of the name and have been unable to do so. The person filing must certify that the name holder has not filed any documents in the last three years, that certified mail was sent and returned undeliverable, and that no telephone listing or current business activity can be found for the entity holding the name.
