STATEMENT OF ARBITRABILITY. This form is used in Mason County Superior Court to determine whether a case is eligible for mandatory arbitration. The form allows the parties involved to assert whether their case meets the criteria for arbitration under Washington state law. It includes options for the filing party to indicate if the case involves a money judgment of $100,000 or less, excluding attorney fees, interest, and costs, or if it pertains to the establishment, modification, or termination of maintenance or child support payments. Additionally, the form allows a party to waive any claims exceeding $100,000 specifically for the purpose of arbitration or to indicate that the case has already been submitted to mediation but was unsuccessful. On the other side, the opposing party can file a response stating that the case is not subject to mandatory arbitration, typically if the plaintiff’s claim exceeds $100,000, seeks relief other than a money judgment, or if the defendant’s counterclaim exceeds the arbitration threshold.
