REQUEST FOR HEARING PERSONAL EARNINGS. This form is used by a judgment debtor to dispute the garnishment of their personal earnings. If the debtor believes that the garnishment is improper or that their wages should not be garnished, they can request a hearing with the court. This form must be submitted within five business days of receiving the garnishment notice. The debtor can indicate if they consider the need for the hearing to be an emergency. The form allows the debtor to state the reasons for disputing the garnishment. It also includes a warning that failure to submit the request for a hearing within the time frame will waive their right to a hearing, resulting in their wages being garnished to pay the judgment.
