Description

CHILD PROTECTIVE ORDER. This form is used in the Utah District Juvenile Court to provide legal protection for a minor who has been abused or is at risk of abuse. This court-issued order is typically requested by a petitioner—such as a parent, guardian, or custodian—and, after a hearing, may be granted if the court finds sufficient evidence of abuse or imminent danger. The order legally restrains the respondent (the person accused of abuse) from committing or threatening abuse, and may include restrictions on contact, communication, or proximity to the child, the child’s home, school, place of worship, or other frequented locations. It may also prohibit the respondent from possessing firearms, award the child possession of personal belongings, and grant the petitioner custody. In some cases, the respondent may be ordered to pay child support, share in the cost of the child’s care and medical expenses, or participate in mandatory income withholding. Law enforcement is authorized to assist in enforcing the order, including retrieving the child or enforcing removal provisions. Violation of this order may result in arrest or criminal charges.
