TRANSFER ON DEATH INSTRUMENT. This form is used to create a legally binding Transfer on Death Instrument (TODI) under the Illinois Residential Real Property Transfer on Death Instrument Act, 755 ILCS 27/1. It allows a property owner, referred to as the grantor, to designate one or more beneficiaries who will automatically receive ownership of specified residential real estate upon the grantor's death, without the need for probate. The form identifies the grantor, the legal description of the real estate, the parcel number, and the property address. It also states that any prior TODIs related to the same property are revoked.
