Description

RSC-4 - DISCLOSURE OF RELATIONSHIP WITH CONTRACT PROVIDER OR ADMINISTRATOR. This form promulgated by the Texas Real Estate Commission (TREC) and dated 05-16-2023, is used to inform buyers and sellers in a real estate transaction about the nature and optional purchase of a residential service contract—commonly known as a home warranty. This form explains that a residential service contract is a service agreement in which a licensed provider, for a fee, agrees to repair or replace certain systems or appliances in the property, with typical co-payments required for service calls. The form emphasizes that purchasing such a contract is strictly optional and that buyers have the freedom to choose any provider. It also clarifies that neither the seller nor any real estate agent involved may require the buyer to purchase a service contract as a condition of the sale. The form discloses whether the listing broker or the other broker/sales agent receives compensation from a specific provider for services rendered—such as marketing or administrative support—and states that any such compensation is not contingent upon the buyer’s purchase of a service contract. www.FormsWorkflow.com
