TR-128 - NOTICE AND WAIVER OF RIGHTS AND REQUEST FOR REMOTE VIDEO PROCEEDING. This form is used by a defendant in a traffic infraction case in the Superior Court of California, County of Contra Costa, to request a remote video proceeding (RVP) for either their arraignment or trial. By choosing RVP, the defendant waives certain rights, such as the right to appear in person for arraignment, the right to a speedy trial within 45 days, and the right to be physically present in court for trial and other proceedings. The defendant acknowledges that they will be required to appear at the designated off-site location for the RVP and agrees to abide by the court's orders regarding the remote appearance. They also acknowledge the responsibility of checking the court website for RVP information, logging on to the RVP at the specified date and time, and filing the form with the court at least 5 court days before the due date or trial date. The form also includes a declaration under penalty of perjury that the information provided is true and correct. It reminds the defendant to conduct themselves as if they were appearing in person in court and warns of the consequences of failing to appear as promised, such as forfeiting any posted bail or facing a civil assessment.
