FL-541, APPLICATION FOR RECOGNITION OF TRIBAL COURT ORDER DIVIDING RETIREMENT PLAN OR OTHER DEFERRED COMPENSATION, This form is for use by an applicant when the other party to the tribal court action has not agreed to or is unable to proceed with the filing of a joint application for recognition. If both parties to the tribal court action agree to the application, use the Joint Application for Recognition of a Tribal Court Order Dividing Retirement Plan or Other Deferred Compensation (form FL-540). Use this form to ask the court to recognize a tribal court order that establishes a right to child support payments, spousal support payments, or marital property rights for a spouse, former spouse, child, or other dependent of a participant in a retirement plan or other plan of deferred compensation, and assigns all or part of the benefits to an alternative payee. You can make this application in the superior court of the county in which either party to the tribal court action resides. (Code of Civil Procedure, § 1733.1(c).) You must have the tribal court complete the certificate on page 2 and attach a certified copy of the tribal court order. Note: Recognition of a tribal court order based on this application does not give a court of this state jurisdiction to modify or enforce the tribal court order.
