DEED OF TRUST. This is an Illinois land-trust conveyance form used to transfer real estate to a named trustee under the terms of a written trust agreement. The document identifies the grantor(s), the trustee, the trust agreement date, and the trust number, and provides for the automatic appointment of a successor trustee if the original trustee cannot serve. It contains broad trustee powers—including authority to sell, lease (up to 198 years), mortgage, exchange, subdivide, vacate, dedicate, or otherwise manage or dispose of the property—without requiring beneficiaries or third parties to verify the trustee’s authority. The deed also clarifies that beneficiaries hold only personal property interests in the proceeds or earnings of the trust, not title to the real estate itself.
