(PROPOSED) STIPULATION AND ORDER FOR THE PRODUCTION AND EXCHANGE OF CONFIDENTIAL NFORMATION. This is a standard New York Supreme Court Commercial Division protective order, often used before Justice Andrew Borrok, to regulate how parties handle confidential materials during litigation. It is entered pursuant to CPLR 3103(a) and is designed to protect trade secrets, proprietary data, and other sensitive information disclosed during discovery. Under this order, parties may designate materials as “Confidential Information” and restrict their use to the current litigation. Disclosure is limited to attorneys, their staff, experts, the court, and approved witnesses. The stipulation also provides a framework for disputing confidentiality designations, addressing inadvertent disclosure of privileged materials, filing sealed documents through NYSCEF, and returning or destroying confidential data at the conclusion of the case.
