Wage Deduction Order

WAGE DEDUCTION ORDER. This form is used in the Illinois Circuit Court to authorize and enforce the garnishment of a debtor’s wages to satisfy a monetary judgment. Once a Wage Deduction Summons has been served on an employer and a proper answer is filed, the court issues this order to impose a lien on the non-exempt wages of the defendant. The order directs the employer to deduct a specific percentage—typically 15%—of the defendant's non-exempt gross wages each pay period, subject to applicable minimum wage protections and any pre-existing support obligations for a spouse or child. The deducted wages are to be remitted regularly to the plaintiff or their attorney until the total amount owed—including judgment, interest, and court costs—is paid in full.
