DEFENDANT: PLEA FORM - ATTACHMENT FIVE (DEFERRED ENTRY OF JUDGMENT DRIVING PROGRAM) CASE NUMBER: INSTRUCTIONS: Read, date, and sign this form if you wish to plead guilty or no contest and participate in the Deferred Entry of Judgment Driving Program (DEJDP). If you successfully complete the DEJDP your case will be dismissed. If you do not successfully complete all requirements of the DEJDP, the Court will enter judgment based on your guilty or no contest plea at the scheduled sentencing hearing. If you have any questions about your case, the possible sentence, or the information on this form, ask your attorney or the judge. DEFERRED ENTRY OF JUDGMENT PROGRAM RULES AND CONSEQUENCES 1. I understand that, as part of the DEJDP, I will be required to contact Pacific Educational Services (PES) within 5 days and attend an education workshop within 90 days of this court order, and obtain a valid California Drivers License within 180 days from this court order, pay all fees, pay restitution (if applicable) and not commit any new crimes while enrolled in this program. 2. I understand that the Court will order me to pay a program fee of $270.00 and victim restitution in the amount of $ (if applicable) to Pacific Educational Services. I will also be required to pay a one-time $25.00 collection and monitoring fee. If restitution is owed, I may be subject to additional collection and monitoring fees. 3. I understand that NO EXTENSIONS OF TIME OR RE-REFERRALS to the program will be granted, nor will I be entitled to a hearing on these issues. I also understand that I may participate only one time in this program. 4. I understand that I will be terminated from the program if I attend any of the classes under the influence of alcohol or drugs. 5. I understand that my signature serves as consent for PES to release any information in my participant file to the Napa Superior Court and District Attorneys Office. 6. I understand that if I fail to successfully complete all requirements of the DEJDP then all the consequences of my plea will be imposed at the scheduled Sentencing hearing date. I understand that I will not be entitled to a hearing on whether or not I successfully completed the program prior to sentencing and that my sentencing date may be advanced if I fail. 7. I understand that the Court will schedule a hearing for sentencing approximately eight (8) months from todays date. I will not need to appear at this hearing if I have successfully completed the DEJDP. I understand that I am REQUIRED to appear at this hearing if I have NOT successfully completed the DEJDP. I also understand that if I do not appear the Court will issue a bench warrant for my arrest.
