ORDER APPROVING STIPULATION AND DISMISSING ADVERSARY CASE The Court has reviewed the Stipulation filed on providing for settlement of this adversary proceeding by the Defendant222s payment of $ according to a schedule stated in the Stipulation. Under the Stipulation, if the Defendant fails to make a required payment, the Plaintiff will be entitled to a judgment that the debt is nondischargeable. IT IS THEREFORE ORDERED: the Stipulation is approved. IT IS FURTHER ORDERED: this adversary proceeding is dismissed, subject to the right of the Plaintiff to reopen and obtain a judgment in the event of default, and the Court retains jurisdiction for that purpose. IT IS FURTHER ORDERED: this adversary case will be closed, and if the Defendant defaults on a payment on the Stipulation, the Plaintiff may file and serve a Motion to Reopen and Affidavit of Default. The Defendant will have 14 days to object to the Motion. In the event of a timely-filed objection, the Court will hold a hearing on the sole issue of whether there has been a default.
