50.300 Prescription; Cotenants There may be no adverse possession against a cotenant until the adverse possessor effects an actual ouster and retains exclusive possession; in such event, the cotenant may bring an action to recover possession. O.C.G.A. §44-6-123 When two or more persons own lands jointly, they are known in law as cotenants, and possession of one would constitute possession of all, and there could be no adverse possession on the part of one against the other or others until an actual ouster, or exclusive possession after demand, or express notice of adverse possession.
