FORM 17.8 - COURT INVESTIGATORS REPORT ON PROPOSED GUARDIANSHIP [R.C. 2111.041]. This form is used in the Ohio Probate Court when a guardianship of an adult or minor is proposed. The investigator compiles findings on the individual’s mental, physical, and functional capacity, living conditions, and understanding and attitude toward guardianship, along with any risks or special needs relevant to the appointment. The report documents where and how notice of the proceeding was served, summarizes the individual’s condition based on observation and interviews, and identifies any discrepancies between the investigator’s findings and the expert evaluation. It also addresses powers of attorney, living wills, advance directives, or other existing legal instruments. The investigator must evaluate the need for a guardianship—whether of the person, estate, or both—and may recommend a limited guardianship or less restrictive alternative if appropriate.
