CM33 - ORDER TO REMOVE GUARDIAN AND APPOINT A SUCCESSOR GUARDIAN OF THE PERSON AND PROPERTY (ACCOUNTINGS WAIVED. This form is used by the Court of Chancery of the State of Delaware when a petition has been filed to remove an existing guardian and appoint a new one for a person with a disability. The order is issued after notice has been provided to all interested parties and no objections have been filed. It formally removes the current guardian and releases them from their bond obligation, while appointing a successor guardian with full legal authority over both the personal and financial affairs of the person with a disability under 12 Del. C., Chapter 39. The new guardian must file a bond with the court before assuming responsibilities. The order outlines the new guardian’s duties, including taking possession of all records and property from the former guardian within thirty days, applying to be the Social Security representative payee, filing annual updates and medical statements, and managing any future financial or property interests. It also specifies that court approval is required for major transactions such as opening a safe deposit box or selling real property.
