CM71 - ORDER APPOINTING ATTORNEY AD LITEM. This form is used by the Court of Chancery of the State of Delaware when a petition has been filed to terminate an existing guardianship for the purpose of appointing a substitute decision maker for a person with a disability. Through this order, the court appoints an attorney ad litem to represent the best interests of the person with a disability and to independently evaluate whether the proposed termination of guardianship is appropriate. The attorney is directed to investigate the facts of the case, including the current medical, financial, and educational circumstances of the individual, and to provide a written report with recommendations within 20 days. The order grants the attorney broad authority to access confidential information from healthcare providers, financial institutions, government agencies, and educational institutions, and permits the investigation to be conducted remotely if necessary. Strict confidentiality requirements are imposed, and the attorney must return or destroy all sensitive materials at the end of the proceedings.
