Description

CM39 - FINAL ORDER TO ACCEPT TRANSFER OF FOREIGN GUARDIANSHIP (ACCOUNTINGS WAIVED). This form is used by the Court of Chancery of the State of Delaware to recognize and establish a guardianship over both the person and property of an individual with a disability that was originally ordered in another state. After reviewing the petition and certified foreign guardianship orders, the court appoints the named individual as guardian, granting them full legal authority under Delaware law (12 Del. C., Ch. 39) to care for and manage the affairs of the person with a disability. Before beginning their duties, the guardian must file a bond to ensure faithful performance. The order outlines the guardian's responsibilities, including submitting annual updates and medical statements, acting as representative payee for Social Security benefits, and managing taxes. The guardian must also report to the court if the person with a disability becomes Medicaid qualified or earns income beyond a specified threshold. While the guardian is excused from opening a guardianship account or filing financial accountings unless certain financial conditions arise, court approval is required for significant transactions involving the person's property. www.FormsWorkflow.com
