Form CM49 - ORDER TO WAIVE GUARDIANSHIP BANK ACCOUNT. This form is used in the Delaware Court of Chancery to waive the requirement for a guardian to maintain a separate guardianship bank account on behalf of a person with a disability. Through this order, the guardian is authorized to close the existing guardianship account while remaining relieved of the obligation to file annual accountings. However, the guardian must still submit an annual update and medical statement and promptly report any new income or financial changes involving the person with a disability. If the individual earns more than $1,000 in a month, excluding Social Security benefits, or if additional funds or property come into the guardian’s possession, the Court must be notified within thirty days for review and direction.
