Description
CR-188 - PETITION/APPLICATION (Health and Safety Code, § 11361.8) ADULT CRIME(S). This form is used in the Superior Court of California, County of Nevada, for individuals seeking relief under Proposition 64, which reclassified certain marijuana-related offenses. The form allows a petitioner to request one of two main types of relief: (1) resentencing if they are currently serving a sentence for a qualifying offense, or (2) redesignation, dismissal, and sealing of the conviction if they have already completed their sentence. The petitioner must provide detailed information about the original conviction(s), including the specific Health and Safety Code section, the nature and quantity of marijuana involved, and the petitioner’s age at the time of the offense. The form also includes optional waivers for having the matter heard by the original sentencing judge and for personal appearance at any hearing. Optional Form. www.FormsWorkflow.com
