CRM206 - RESPONSE AND ORDER ON PETITION FOR RESENTENCING. This form is used by the Superior Court of California, County of Nevada, to document the court’s and prosecution’s response to a defendant’s petition under Penal Code § 1170.18 (Proposition 47). The form is initiated after a defendant submits a petition requesting that certain felony convictions be resentenced or reclassified as misdemeanors, either because the sentence is still being served or has already been completed. The prosecuting agency, typically the District Attorney, uses the form to indicate whether it agrees that the specified counts qualify for resentencing or reduction, or to object and state the reasons for ineligibility—such as prior disqualifying convictions or public safety concerns. The court completes the lower section of the form to issue a ruling: granting or denying the petition, setting a hearing, or modifying probation.
