Description

EDC 6-100 - ORDER CLOSING CHAPTER 13 CASE WITHOUT DISCHARGE. This form is issued by the United States Bankruptcy Court for the Eastern District of California when a debtor in a Chapter 13 bankruptcy case has failed to meet one or more legal requirements necessary to receive a discharge of their debts. The form outlines various possible reasons for the denial of discharge, such as the debtor not completing a required financial management course, failing to file the necessary certificates regarding exemptions or completion of plan obligations, or not paying domestic support obligations. It may also be used when the debtor has already received a discharge in a prior bankruptcy case within a certain time frame, making them ineligible for another discharge. By closing the case without a discharge, the court ends the bankruptcy proceeding without eliminating the debtor’s remaining eligible debts. If the debtor subsequently files a Motion to Reopen the case, the debtor must pay the full fee due for filing such a motion (currently $235.00 for a chapter 13 case). www.FormsWorkflow.com
