EOIR-42B - APPLICATION FOR CANCELLATION OF REMOVAL AND ADJUSTMENT OF STATUS FOR CERTAIN NONPERMANENT RESIDENTS. This form is used by certain individuals in removal (deportation) proceedings to request legal relief that would allow them to remain in the United States and obtain lawful status. Specifically, this form is for nonpermanent residents—those who do not have lawful permanent resident (green card) status—who meet strict eligibility criteria under Section 240A(b) of the Immigration and Nationality Act (INA). To qualify, applicants must demonstrate, among other requirements, that they have maintained continuous physical presence in the U.S. for at least 10 years, have been persons of good moral character during that time, have not been convicted of disqualifying crimes, and that their removal would cause exceptional and extremely unusual hardship to a U.S. citizen or lawful permanent resident spouse, parent, or child. The form may also be used by individuals (or parents of children) who have been subjected to domestic violence by a U.S. citizen or lawful permanent resident spouse or parent and who meet a slightly different set of criteria, including three years of physical presence and proof of abuse.
